Terms of service

Terms of Service

These Terms apply whenever you browse our website, place an order, create an account, or purchase products from The Derma Co.

Please read them carefully before ordering. By buying from us, you agree that these Terms apply to your purchase.

1. The Seller

Products purchased through this website are sold by The Derma Co.

We manage the sale, payment, invoicing, dispatch, customer support, and any return or refund process that may apply.

2. Customer Eligibility

You must be aged 18 or over to place an order.

By ordering from us, you confirm that all information you provide is accurate and that you are legally permitted to purchase the products selected.

Where a product is intended for professional aesthetic or cosmetic use, you confirm that you are appropriately trained, qualified, insured, and competent to purchase and use that product, or that you are purchasing on behalf of someone who is.

3. Professional Products

Some products on this website are intended only for use by trained professionals.

These products are not suitable for self-use by members of the public and must not be used by anyone without the necessary training, insurance, and professional knowledge.

It is your responsibility to make sure the product is suitable for your intended use and that you comply with all applicable laws, regulations, professional guidance, and manufacturer instructions.

4. No Medical Advice

Information on this website is provided for general product reference only.

Nothing on this website should be treated as medical advice, treatment advice, clinical guidance, or a substitute for assessment by an appropriately qualified professional.

Before using any product, you must check the manufacturer’s instructions, packaging, contraindications, warnings, expiry date, storage requirements, and any supplied documentation.

5. Product Information and Availability

We aim to keep product details accurate, but descriptions, images, packaging, specifications, ingredients, strengths, sizes, and availability may change.

Images are for illustration and may not always reflect the exact packaging supplied.

Where there is any difference between website information and the manufacturer’s official packaging or instructions, the manufacturer’s information takes priority.

We may amend product information, pricing, stock availability, or product ranges at any time.

6. Orders

When you submit an order, you are offering to buy the products in your basket.

We may decline, cancel, or limit an order where we consider it necessary. This may include situations involving stock errors, payment issues, pricing mistakes, suspected fraud, incorrect information, compliance concerns, or unsuitable product use.

If payment has already been taken for an order we cancel, we will refund the cancelled item or order.

7. Pricing and Payment

Prices are shown on the website at the time of ordering.

Payment must be received and cleared before goods are dispatched.

If a pricing or listing error occurs, we are not required to supply the product at the incorrect price. We may cancel the order or contact you to confirm whether you wish to proceed at the correct price.

VAT will be applied where required under UK law.

8. Product Traceability

Where applicable, products may include batch numbers, serial numbers, expiry dates, or other identifying information.

We may record this information for quality control, safety, compliance, customer service, and recall purposes.

You must inspect all products immediately upon delivery. Any issue must be reported before the item is opened, used, altered, transferred, stored incorrectly, or disposed of.

9. Storage After Delivery

Once delivered, responsibility for proper storage and handling passes to you.

You must store products exactly as instructed by the manufacturer. This may include requirements relating to temperature, refrigeration, light exposure, sealed packaging, sterility, expiry dates, and safe handling.

We are not responsible for any loss, deterioration, contamination, reduced effectiveness, or damage caused by incorrect storage or handling after delivery.

10. Your Responsibility for Use

You are responsible for how products are used after purchase.

The Derma Co is not liable for injury, adverse reaction, loss, damage, complaint, claim, or other consequence caused by:

  • self-use or self-administration;

  • use by an unqualified person;

  • incorrect storage or handling;

  • use outside manufacturer guidance;

  • failure to check suitability or contraindications;

  • unlawful, unsafe, or negligent use;

  • use after expiry;

  • onward supply to an unsuitable person;

  • failure to follow relevant professional standards.

You agree to cover The Derma Co against any claim, cost, loss, liability, or damage arising from your misuse, onward supply, storage, handling, or use of the products.

11. Dispatch and Delivery

We aim to process orders promptly during normal working days.

Orders placed before our stated cut-off time may be processed the same working day where stock, payment, and operational checks allow.

Orders placed after the cut-off time, during weekends, or on public holidays will usually be handled on the next working day.

Delivery options and costs are shown at checkout.

Delivery timeframes are estimates only. They are not guaranteed unless we expressly state this in writing for a specific service.

We are not responsible for delays caused by couriers, incorrect delivery details, failed delivery attempts, access issues, weather, strikes, customs, public holidays, or events outside our control.

12. Tracking and Receiving Orders

Where tracking is available, details will be provided after dispatch.

You are responsible for monitoring tracking updates and ensuring that the delivery address is correct and accessible.

If you provide incorrect delivery information, select an unsafe delivery option, fail to collect a parcel, or are unavailable to receive delivery, we are not responsible for resulting delay, loss, or additional cost.

13. International Deliveries

Customers outside the UK are responsible for checking that products can legally be imported, possessed, sold, or used in their destination country.

You are responsible for customs duties, import taxes, local fees, clearance requirements, and any local restrictions.

We are not responsible for parcels delayed, returned, seized, destroyed, refused, or held because of customs, import rules, regulatory checks, or failure to comply with local requirements.

14. Delivery Problems

You must check your parcel as soon as it arrives.

Any damaged, missing, incorrect, or defective item must be reported within 3 days of delivery.

You may be asked to provide photographs of the outer packaging, inner packaging, shipping label, product, batch details, and any visible damage.

Do not dispose of packaging until the issue has been reviewed.

Where a courier investigation is required, we will assist where reasonably possible, but a refund or replacement may depend on the outcome of that investigation.

We are not liable for business losses, missed appointments, cancelled treatments, loss of profit, or other indirect losses caused by delivery problems.

15. Returns

Due to the nature of the products we sell, returns are limited.

A return may only be accepted where:

  • the item is unopened;

  • the item is unused;

  • the item is in its original packaging;

  • the item matches the batch or serial details originally supplied;

  • the issue is reported within the required timeframe;

  • the return is approved by us before being sent back.

Items must not be returned without prior approval.

We may refuse a return where the product has been opened, used, tampered with, damaged after delivery, stored incorrectly, relabelled, partly missing, contaminated, or no longer suitable for resale.

16. Sterile, Sealed, and Temperature-Sensitive Goods

Sterile, sealed, hygiene-sensitive, temperature-sensitive, or professional-use products cannot usually be returned once dispatched.

This applies even if the item is unused.

The only exception is where a genuine manufacturing defect is confirmed or where we are legally required to accept the return.

17. Refunds

Approved refunds will be made to the original payment method.

Refunds are normally processed within 7 working days after the returned product has been received, checked, and approved.

Original delivery charges are not automatically refundable where the order was dispatched.

Return postage is your responsibility unless we agree otherwise.

18. Exchanges and Cancellations

Orders may only be cancelled before dispatch.

Once an order has been dispatched, it cannot be cancelled unless you have a legal right to cancel.

Exchanges are only offered where an item is confirmed to be defective, damaged, or incorrectly supplied.

19. Website Misuse

You must not misuse this website.

This includes placing fraudulent orders, providing false information, attempting to interfere with the website, copying content without permission, scraping data, or using the website in a way that may cause harm to us, our customers, or our systems.

We may suspend access, cancel orders, or refuse future service where we believe misuse has occurred.

20. Limits on Our Liability

Our liability for any order is limited to the amount paid for the product that gave rise to the claim.

We are not responsible for indirect, consequential, or business-related losses, including:

  • loss of profit;

  • loss of income;

  • missed appointments;

  • cancelled bookings;

  • business interruption;

  • reputational harm;

  • loss of opportunity;

  • courier delays;

  • third-party failures.

Nothing in these Terms excludes liability where the law does not allow us to do so.

21. Changes to These Terms

We may update these Terms at any time.

The version published on this website at the time you place your order will apply to that order.

22. Governing Law

These Terms are governed by the laws of England and Wales.

Any dispute relating to these Terms, this website, or any order placed with The Derma Co will be dealt with by the courts of England and Wales.
